While the latest legislation may not be the most exciting topic, it is always a good idea to stay informed and up-to-date. With 2018 quickly approaching, let’s take a look at some of the new laws that will go into effect with the new year.

  • Ban-the Box is probably the most talked about piece of legislation this year. Assembly Bill 1008 (AB 1008) takes effect January 1, 2018, and makes it unlawful for an employer with more than 5 employees to include anything on their employment applications pertaining to the applicant’s criminal history. No inquiries may be made during the initial interview process, either.

It is permissible, though, for employers to ask about criminal history after a conditional offer of employment has been made. In this case, employers are required to make an individual assessment that shows a direct link between the nature of the offense and specific job duties of the position sought.

  • AB 168 also goes into effect January 1, and prohibits employers from asking about salary history in any way. This bill was written in the hopes of eliminating pay inequality between men and women. It is important to note that this bill does not prohibit prospective employees from voluntarily disclosing prior salary history.
  • New Parent Leave Act or SB 63 requires employers with more than 20 employees to provide up to 12 weeks of job-protected unpaid leave within one year of a child’s birth, adoption or foster care placement.
  • Although no new legislation has been passed in California regarding marijuana use, it is an often-talked about subject. In 2016 Proposition 64 legalized recreational marijuana use for adults over 21 years of age. However, it is still against federal law! The proposition also did not change any employment-related laws in California, therefore employers may still prohibit the use of marijuana by their employees.

Navigating through the ever-changing laws can be tricky. It is extremely important as an employer to maintain organization-wide compliance.
